New Legislation Aims to Expedite Licensing, Enhance Regulatory Oversight, and Strengthen Public-Private Partnerships
Algiers, Algeria | March 5th, 2025 — Algeria is set to usher in a new era for its mining sector with a proposed law that seeks to accelerate investment, enhance legal and financial guarantees for stakeholders, and reinforce national participation in strategic projects. The legislative overhaul, presented by Minister of State for Energy, Mines, and Renewable Energies Mohamed Arkab before the Economic Affairs Committee of the People’s National Assembly (APN) on Tuesday, marks a significant shift in the country’s approach to resource management and industrial expansion.
According to an official statement from the ministry, the proposed amendments are designed to eliminate bureaucratic hurdles and streamline administrative procedures for obtaining mining licenses, allowing for a faster response to investment applications. By simplifying regulatory frameworks and providing increased transparency, the government aims to attract both domestic and foreign investors while ensuring that national companies retain a strategic stake in major mining ventures.
A cornerstone of the proposed legislation is the mandatory participation of Algerian firms in mining projects, with national companies entitled to hold up to a 20% stake in project capital. This measure aligns with Algeria’s broader economic policy of safeguarding national interests while leveraging foreign expertise and capital to drive growth in the sector.
In an effort to make the sector more appealing to global investors, the draft law includes tax incentives and financial facilitations for high-value projects, along with extended validity periods for mining permits, which will now be transferable and financeable. This move is expected to boost liquidity and stimulate long-term investments, positioning Algeria as a more competitive player in the global mining industry.
The legislative proposal also seeks to modernize access to geological and mining data by establishing advanced digital platforms, ensuring greater transparency and efficiency for prospective investors. Additionally, the law encourages public-private partnerships to facilitate technology transfers and maximize value creation, while reinforcing strict compliance with environmental and technical standards to guarantee the sustainable exploitation of Algeria’s vast mineral wealth.
Beyond regulatory reforms, Arkab underscored the persistent challenges facing Algeria’s mining sector, including low investment in exploration and prospecting, insufficient geological data, and the lack of new major mineral discoveries. These structural issues have hindered production levels and increased reliance on imports for certain mineral resources, underscoring the urgency of reform.
A key feature of the legislative revamp is the empowerment of Algeria’s two mining agencies, granting them expanded regulatory and oversight authority to ensure compliance and efficiency in project execution. Additionally, new provisions have been introduced to capitalize on mining residues, allowing for their systematic recovery and reuse under a well-defined legal framework, a measure aimed at reducing resource wastage and optimizing exploitation.
The proposed mining law signals a decisive shift in Algeria’s economic strategy, reinforcing the country’s ambition to revitalize its mineral industry, attract high-caliber investments, and secure a stronger foothold in the global mining landscape.
