Algiers, Algeria | June 9th, 2024 — Following the convocation of the electoral body by President Abdelmadjid Tebboune this Saturday, the electoral process will move through several stages defined by the organic law related to the electoral system.
Starting Sunday, the National Independent Election Authority (ANIE) will distribute subscription forms for individual signatures to presidential candidates, before beginning to receive declarations of candidacy.
Submission of Candidacy Declarations
According to Article 249 of the organic law, “the declaration of candidacy for the Presidency of the Republic is made by submitting a registration request to the President of the Independent Authority by the candidate himself, against a receipt.”
Candidates must submit personal details, such as name, surname, profession, and address, along with several documents:
– An original and complete copy of the birth certificate.
– An Algerian nationality certificate of origin.
– A written and signed commitment by the candidate to not use the fundamental components of national identity for partisan purposes, to preserve national sovereignty, the integrity of the national territory, and respect the principles of the Republic.
40 Days to Submit Candidacies
Per Articles 251 and 252, “the declaration of candidacy must be submitted no later than forty (40) days after the publication of the presidential decree convening the electoral body.”
The Independent Authority will then decide on the validity of the candidacies within a maximum of seven (7) days from the date of submission. If a candidacy is rejected, the candidate can appeal to the Constitutional Court within 48 hours of notification.
The Independent Authority will transmit its decisions regarding the candidacies, along with the candidates’ files, to the Constitutional Court within 24 hours.
Collection of Signatures
To be validated as a candidate, Article 253 requires candidates to present either:
– A list with at least 600 individual signatures from elected members of municipal, provincial, or parliamentary assemblies, spread across at least 29 provinces.
– Or a list with at least 50,000 individual signatures from registered voters, also spread across 29 provinces, with a minimum of 1,200 signatures per province.
Validation and Campaign Period
The Constitutional Court will validate the final list of candidates within seven (7) days from receiving the last decision from the Independent Authority.
Once validated, candidates will begin their electoral campaigns, which start 23 days before the election date and end three days before the election, as per Article 73 of the organic law.
Eligibility Criteria
Candidates must meet specific eligibility criteria:
– Be of Algerian nationality by origin and attest to the Algerian nationality of both parents.
– Not hold any foreign nationality.
– Be at least 40 years old on the day of the candidacy declaration.
– Have resided exclusively in Algeria for at least ten years before submitting the candidacy.
– Publicly declare their movable and immovable assets, both within and outside Algeria, as per Article 87 of the Constitution.
The presidential election is conducted by a two-round majority vote. If no candidate achieves an absolute majority in the first round, a second round is held with only the top two candidates from the first round.
