CJEU: Polisario Welcomes “Decisive Progress” in Recognition of Sahrawi People’s Right to Self-Determination

ALGIERS- The Polisario Front has expressed its satisfaction on Thursday with the “decisive progress” made in recognizing the Sahrawi people’s right to self-determination, following the publication by the Court of Justice of the European Union (CJEU) of the Advocate General’s conclusions on the EU-Morocco fisheries agreements and the origin of Sahrawi agricultural products.
“In this legal battle initiated ten years ago, significant progress has been made,” emphasized the Polisario Front in a statement, stressing that “there is no discussion about the admissibility of legal actions by the Sahrawi people.” It asserted that “the Advocate General adopts the arguments of the Polisario Front regarding the right to self-determination and the permanent sovereignty of the Sahrawi people over natural resources.”
“All of this aligns with a body of jurisprudence favorable to the Sahrawi people, which is being confirmed step by step,” it supported. Referring to the case of the origin of agricultural products, the Polisario Front recalled that the Advocate General concluded that “given the separate and distinct status of the Sahrawi territory, under the right to self-determination, melons and tomatoes from the Western Sahara territory must bear on their labeling an indication of the country of origin reflecting their origin from this territory. These products cannot indicate Morocco as the country of origin.”
“Applying to the case of Western Sahara the Court’s jurisprudence on products from settlements in occupied Palestine, this solution illustrates the proximity of the cause of the Sahrawi people to that of the Palestinian people,” it noted.
Regarding the EU-Morocco fisheries agreement, the Polisario Front highlighted that the Advocate General concluded the “dismissal of the appeal by the European Council and Commission.” According to her, “by not considering the territory of Western Sahara and the adjacent waters as separate and distinct from Morocco, the European Council did not respect the right to self-determination of the people of Western Sahara.” “This situation is therefore contrary to the principle of self-determination established by the Court in its historic judgment of December 21, 2016,” concluded the Polisario Front.
