Dzair Tube Sources Expose France’s Breach of Bilateral Agreements: Systematic Violations Against Algerians and International Conventions

Algiers, Algeria | January 20th, 2025 — France has demonstrated blatant disregard for its bilateral obligations with Algeria by systematically violating the 1974 Consular Agreement and the 1968 Algerian-French Accord. These violations, which include failing to notify Algerian consulates of the arrests of Algerian citizens and obstructing their fundamental rights, expose a troubling pattern of discrimination and institutional negligence.

Reliable sources from Dzair Tube reveal that French authorities persist in detaining Algerian nationals without informing Algeria’s diplomatic missions, in direct contravention of Article 36 of the 1963 Vienna Convention on Consular Relations. This clause explicitly mandates that states promptly notify the consular posts of the detainee’s country to enable consular support, such as legal assistance, psychological aid, and the safeguarding of basic rights.

This systematic failure has left many detained Algerians unable to access consular support, amplifying their vulnerability. Documented cases detail severe rights violations, including arbitrary arrests, prolonged detentions without cause, and limited access to interpreters or legal counsel. Such practices violate international standards, including the Universal Declaration of Human Rights and the European Convention on Human Rights, particularly the right to a fair trial and humane treatment.

Additionally, France has imposed excessive bureaucratic barriers on Algerian detainees, requiring them to produce consular travel permits, despite deliberately failing to notify Algerian authorities within the mandated timeframe. This circular impediment obstructs administrative and judicial processes, prolonging detentions and exacerbating the suffering of Algerians detained on French soil.

Beyond these consular violations, France has progressively undermined the 1968 Algerian-French Accord, which guaranteed specific rights for Algerian citizens regarding residency, employment, and social benefits. Through restrictive interpretations by the French Council of State and administrative courts, the agreement’s provisions have been hollowed out. Algerians now face heightened difficulties in securing residence permits, social benefits, and access to basic rights.

The online ANEF platform, ostensibly designed to streamline administrative procedures for foreigners, has become another obstacle. The platform’s convoluted processes and extended response times leave Algerians trapped in uncertainty. Even dual nationals with French citizenship face discriminatory hurdles, raising questions about systemic bias within the French administration.

Despite these adversities, Algeria’s consular missions have shown remarkable diligence, processing over 70% of travel permit requests efficiently. However, French authorities attempt to deflect blame for their failures by accusing Algeria of non-cooperation, an assertion disproven by tangible data and procedural transparency from Algerian institutions.

The French government’s actions stand in stark contradiction to the spirit of mutual respect and cooperation that underpins the 1968 and 1974 agreements. These violations risk eroding diplomatic relations and fostering deep mistrust. Algeria has every right to demand accountability and international scrutiny of these practices, which undermine the principles of equality, justice, and human dignity.
