Algiers- Algeria, May 14, 2024 – The Algerian delegation participating in the Diplomatic Conference in Geneva for the conclusion of an international legal instrument on intellectual property relating to genetic resources and traditional knowledge associated with them, pointed out the illegal confiscation of the Palestinian people’s resources and the systemic destruction of their material and immaterial heritage due to the illegal practices of the Zionist occupier.
The delegation emphasized that the holding of this diplomatic conference in Geneva from May 13 to 24 is the result of strenuous efforts by the member states to establish a more inclusive and flexible intellectual property system that would contribute to the protection of forms of creativity and innovation directly and indirectly dependent on genetic resources and associated traditional knowledge.
In this regard, the Algerian side advocated for the “international instrument under negotiation to recognize the obligation for patent applicants based on genetic resources and traditional knowledge to disclose the origin or source of these, and that this provision be accompanied by appropriate coercive measures to ensure its implementation. This also involves the need to provide for the complementary nature between the envisaged instrument and other international agreements on equitable access and benefit-sharing.”
“The benefits of adopting an ambitious international instrument on intellectual property, genetic resources, and associated traditional knowledge, including through the harmonization of different national systems, the enhancement of sustainable development of communities and local economies, ensuring legal security, providing predictability for businesses, and improving the quality, competence, and transparency of the patent system,” it highlighted.
Illegal Confiscation of Palestinian Resources
“During the preparations for this diplomatic conference, Algeria had the honor of hosting a regional preparatory meeting of African countries in June 2023, which allowed for the coordination of the African position regarding the negotiations concerning the international instrument in question while developing a common understanding and consensus concerning it,” recalled the Algerian representatives, who expressed Algeria’s willingness to “act constructively and with an open mind to contribute to the success of this conference, which we want to be a new milestone in the process of strengthening multilateralism and developing a more inclusive, balanced, and equitable intellectual property system.”
The Algerian delegation also drew the conference’s attention to the illegal confiscation of the Palestinian people’s resources and the systemic destruction of their material and immaterial heritage due to the illegal practices of the Zionist occupier, while reaffirming its support for the statements read by the Kenyan and Indonesian delegates, respectively, on behalf of the African Group and the Group of Like-Minded Countries.
