Justice: Conference on legal, judicial protection of investments in Algeria

ALGIERS- The international conference on “the support and protection of investments in Algeria” opened, Tuesday in Algiers, its work to look into the legal and judicial system relating to the protection of investment in Algeria.

 

This conference will examine three main areas, namely the presentation of the national and international legal framework for investment, the legal and judicial requirements capable of encouraging investment and international agreements attracting and consolidating investment.

 

Supervising the launch of the work, the Director of Studies at the Ministry of Justice, Mr. Touati Yahia indicated, during this conference organized over two days, in cooperation with the German Foundation for International Legal Cooperation, that this conference focused on “the protection of investment in Algeria, in accordance with the legal system adopted by the program of the President of the Republic, Mr. Abdelmadjid Tebboune, in the facilitation of investment and the drainage of capital in Algeria”.

 

The legal and judicial protection of investments and investors has become “the main concern of public authorities”, according to Mr. Touati, indicating that the concept of protection “is of great importance, given the inconstancy of the legislative and organizational framework leading investors to move towards investing in strategic natural resources away from economic activities that add value”.

 

The 2020 Constitution “gave more freedom in investment and entrepreneurship, and gave rise to the publication of the law relating to investment (22-18 of July 24, 2022), with the aim of addressing the shortcomings noted in the old regulatory texts, while strengthening the protection of the legal framework for investments”, he argued.

 

This law provides for provisions promoting investment and conferring more transparency and equality in national and foreign investment projects, said Mr. Touati.

 

The law also provides for the creation of the Algerian Agency for the Promotion of Investment (AAPI) as well as the creation of a digital platform through which files are submitted, with a view to handling requests within ” very short deadlines and without bureaucratic locks”.

 

For his part, the head of the Africa department of the German Foundation for International Legal Cooperation (IRZ), Mohamed Montasser Abidi affirmed that the new law on investment in Algeria “offers sufficient guarantees for investors who seek guarantees and simple procedures”.

 

He considered that the AAPI was one of the mechanisms “capable of stimulating foreign investors”, and that it “will play a pivotal role in this area”.
