Moroccan Bar Association Calls for Implementation of Conditional Release Law for Mohamed Ziane

Algiers, Algeria | May 29, 2024 — The Moroccan Bar Association has issued a strong plea for the implementation of the conditional release law in the case of Mohamed Ziane, a prominent lawyer and former Minister of Human Rights. The association highlights Ziane’s eligibility for conditional release, citing his completion of at least half of his prison sentence and fulfillment of other requisite conditions. The call for his release is particularly underscored by his advanced age and declining health.
In an official statement, the Bar Association has urged the activation of the conditional release law specifically for Ziane. It has also called upon various professional organizations, associations, and human rights groups to unite efforts in advocating for his release, along with that of other individuals detained for political reasons or as prisoners of conscience in Morocco.
Additionally, the Bar Association has announced its intent to attend Ziane’s upcoming trial session scheduled before the Court of Appeal on June 14. This trial pertains to allegations of misappropriation of public funds during his tenure as the leader of the Moroccan Liberal Party. The association has encouraged its members and affiliated professionals to participate actively in large numbers during the trial session.
Ziane himself has formally petitioned for conditional release, citing his deteriorating health and advanced age as reasons. He has invoked Article 59 of the Penal Code, which allows for the premature release of convicted individuals based on their exemplary conduct while incarcerated, with the condition that they continue to exhibit good behavior in the future.
Article 59 of the Penal Code stipulates that “Conditional release is the premature release of a convicted individual due to their good conduct during imprisonment, provided that they maintain good behavior in the future. Conditional release is applied according to Articles 622 to 632 of the Code of Criminal Procedure.”
