ALGIERS- The Algerian People’s National Assembly (APN) has approved significant amendments to the penal code, signaling a comprehensive overhaul aimed at addressing key societal and economic challenges. Led by President Abdelmadjid Tebboune’s reform agenda, the new legislation introduces a range of provisions designed to adapt the law to evolving Algerian society. But what exactly will change with the adoption of this new penal code?
Economic Impact and Investment Security:
One of the primary objectives of the revised penal code is to create optimal conditions for revitalizing the national economy. Notably, the legislation now criminalizes any obstruction to investment, with penalties of up to 12 years in prison for actions aimed at harming the national economy. This measure aims to safeguard investment initiatives and foster economic growth.
Protection of Managers and Anti-Corruption Measures:
A significant provision of the new law is the depenalization of managerial acts, offering protection to administrators from legal liabilities. This move aims to relieve managers from undue legal burdens, fostering a conducive environment for effective governance and decision-making. Additionally, the legislation includes stringent measures to combat corruption and ensure transparency in corporate practices.
Social Welfare and Combatting Malpractices:
In the realm of social welfare, the revised penal code introduces measures to tackle various societal challenges, including the fraudulent acquisition of property and services through false declarations or misrepresentations. Provisions targeting identity theft, abuse of authority, witchcraft-related activities, organized begging, and fuel theft are also included to address prevalent social malpractices.
Enhanced Security Measures:
The legislation strengthens measures to combat organized crime, drug-related offenses, and threats to public safety. It includes provisions to protect law enforcement personnel engaged in confronting criminal activities, providing them with necessary legal safeguards. Furthermore, the penal code criminalizes offenses against national symbols and functions, such as defamation directed at revolutionary figures and attacks on public servants, including teachers and religious leaders.
Cybercrime and Alternative Sentencing:
Recognizing the growing threat of cybercrime, the new penal code introduces stringent penalties of up to 12 years in prison for cyber-related offenses. Moreover, it introduces alternative sentencing methods, such as community service and electronic monitoring, to address overcrowding in prisons and promote rehabilitation.
